Red Robin Employees: Wage & Hour Class and Collective Action Lawsuit

On September 10, 2025, Wise Law LLC filed a collective and class action lawsuit in the Southern District of Illinois against Red Robin International, Inc. alleging unpaid overtime violations under the Fair Labor Standards Act (FLSA) and other state laws, including state minimum wage laws.

Wise Law LLC alleges Red Robin misclassified Assistant Managers, Kitchen Managers, Assistant General Managers, and General Managers across the United States as exempt from overtime, but required them to work long hours performing non-managerial, physically demanding tasks, such as cooking and cleaning, without overtime pay.

Wise Law LLC is also alleging Red Robin (1) prohibited its Salaried and Hourly Managers across the United States from keeping tips / gratuities they earned in violation of the FLSA and other state laws and (2) failed to reimburse employee expenses, such as use of personal cars to deliver catering orders or obtain supplies from other locations, in violation of state laws.
