Attorney Diana E. Wise has over fifteen years of legal experience, including extensive experience in labor and employment & consumer advocacy. Attorney Wise now represents consumers and employees in class and collective actions, as well as individual and mass arbitrations.

FAQs

  • Disputes between consumers/employees and businesses that are arbitrated are resolved by an independent neutral arbitrator rather than in court. Most consumer arbitrations occur because a pre-dispute arbitration clause is "hidden" in a business’s terms and conditions. Most employment arbitrations occur because an employee signs an arbitration agreement as a condition of initial or continued employment.

  • When a person/organization's actions or practices harm many people in the same way, a class action can be filed in court by one or more people (the "named plaintiffs") who seek to represent all those who were harmed. Led by named plaintiffs, those people form a "class" of harmed people. A class action prevents the filing of hundreds or thousands of individual lawsuits regarding the same unlawful conduct, which would burden the judicial system.

    Named plaintiffs are commonly awarded "incentive awards," an additional amount of compensation for representing the class of harmed people (ie: compensation for the named plaintiff’s time and expenses in service to the class).
